2. Collection and Storage of Personal Data as well as Type and Purpose of Use
When Visiting the Website
When you access our website www.tradias.de, information is automatically sent by the browser used on your device to the server of our website. This information is temporarily stored in a so-called log file. The following information is recorded without your intervention and stored until automated deletion:
  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which access is made (referrer URL),
  • Browser used and, if applicable, the operating system of your computer as well as the name of your access provider.
Purposes of Processing:
The aforementioned data is processed by us for the following purposes:
  • Ensuring a smooth connection setup of the website,
  • Ensuring comfortable use of our website,
  • Evaluating system security and stability, and
  • For other administrative purposes.
Legal Basis:
The legal basis for data processing is Art. 6(1)(f) GDPR. Our legitimate interest arises from the purposes for data collection listed above. In no case do we use the collected data to draw conclusions about your identity. Additionally, we use cookies and analysis services when you visit our website. Further details can be found under sections 5 and 6 of this privacy notice.
When Using Our Contact Form
For questions of any kind, we offer you the opportunity to contact us via a form provided on the website. Providing a valid email address is required so that we know from whom the request originates and can respond to it. Additional information may be provided voluntarily.
Legal Basis:
The data processing for the purpose of contacting us is carried out in accordance with Art. 6(1)(a) GDPR based on your voluntarily given consent.
Data Deletion:
The personal data collected by us for the use of the contact form will be automatically deleted after your request has been resolved.
When Initiating or Conducting a Business Relationship
We collect and process, in particular, the following categories of personal data:
  • Contact Information: Full name, address, telephone number, fax number, and email address, as well as additional personal information requested from institutional and natural persons under the German Money Laundering Act (GwG).
  • Business Information: Data necessarily processed in a contractual or other relationship with Tradias GmbH or voluntarily provided by you, such as orders placed, purchases, services, other business transactions, product feedback, and other information you provide or that arises in the context of a business relationship.
  • Information from External Sources: Data obtained from public sources, databases, and credit agencies.
  • Compliance-Related Information: Where legally required, we collect information for compliance purposes, e.g., regarding legal disputes or court proceedings involving you or persons with whom you have a business relationship, as well as information about interactions with you that may be relevant under antitrust law.
Data Processing for Service Providers and Suppliers
We also process personal data in the context of cooperation with our service providers or suppliers. If the service provider or supplier is a company, this includes the data of the company’s employees with whom we collaborate. For example, we process the (professional) contact information of employees who send us order confirmations.
Purpose and Legal Basis:
The processing of personal data is carried out for the purpose of concluding, implementing, or processing agreements with our service providers. The legal basis is:
  • Art. 6(1)(b) GDPR (performance of a contract) if the service provider or supplier is a natural person, or
  • Art. 6(1)(f) GDPR (legitimate interest in business communication) if it is a company.
The information in this privacy notice also applies accordingly to our service providers and their employees.
e. Data Processing in Connection with Applications
In the course of the application process, we process personal data such as:
  • Name, address, contact details, etc., of applicants,
  • Information on professional qualifications, school education, professional training, and career history.
For certain positions, we may require a certificate of good conduct.
Purpose and Legal Basis:
The processing of personal data is carried out to establish a potential employment relationship with the applicant, based on Art. 88 GDPR (in conjunction with § 26 BDSG for applicants in Germany). If an employment relationship is established, we may, under Art. 88 GDPR (in conjunction with § 26 BDSG), continue to process the personal data already received for employment purposes, as necessary for the implementation or termination of the employment relationship.

3. Disclosure of Data
Your personal data will not be transferred to third parties for purposes other than those listed below. We only disclose your personal data to third parties if:
  • You have given your express consent in accordance with Art. 6(1)(a) GDPR,
  • The disclosure is necessary under Art. 6(1)(f) GDPR for the assertion, exercise, or defense of legal claims, and there is no reason to assume you have an overriding legitimate interest in not disclosing your data,
  • There is a legal obligation to disclose under Art. 6(1)(c) GDPR, or
  • It is legally permissible and necessary under Art. 6(1)(b) GDPR for the processing of contractual relationships with you.

4. Duration of Storage of Personal Data
We will store your personal data for as long as necessary to provide the commissioned services, products, or requested information and to manage our business relationship with you. If you have requested us not to contact you, we will retain this information as long as necessary to fulfill that request. Additionally, we are legally obliged to retain certain types of personal data for specific periods (e.g., due to commercial or tax retention obligations). Your personal data will be deleted immediately when it is no longer required for these purposes.

5. Cookies
We use cookies on our website. These are small files automatically created by your browser and stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies store information related to the specific device used but do not directly identify you.
Purpose:
  • User Experience: We use session cookies to recognize that you have visited certain pages of our website; these are deleted automatically after you leave. Temporary cookies, stored for a defined period, enhance user-friendliness by recognizing repeat visits and retaining your settings.
  • Analytics: We use cookies to statistically record and evaluate website usage to optimize our offerings (see section 5). These cookies are deleted after a defined period.
Legal Basis:
The data processed by cookies is necessary to safeguard our legitimate interests and those of third parties under Art. 6(1)(f) GDPR.

6. Recording of Telephone Calls
We are obliged under § 83(3) of the German Securities Trading Act (WpHG) to record telephone conversations between our traders and customers. These recordings may only be accessed under strict conditions, such as at the request of the Federal Financial Supervisory Authority. Access is restricted to authorized persons (a managing director together with a representative from Compliance or Internal Audit), and recordings are deleted after five years, or seven years if requested by the Federal Financial Supervisory Authority.

7. Analysis Tools
For the needs-based design of our website, we create pseudonymous usage profiles using Google Analytics, which employs targeting cookies stored on your device and readable by us. This allows us to recognize and count returning users and determine how often our website is accessed by different users.
Data Stored:
When individual pages are accessed, the following data is recorded:
  • Three bytes of the IP address (anonymized via “anonymizeIP”),
  • The accessed website,
  • The referring website (referrer),
  • Subpages accessed from the page,
  • Time spent on the website,
  • Frequency of visits.
IP addresses are not stored in full; the last part is masked (e.g., 192.168.1.***), preventing assignment to a specific device. We also use Google Analytics for cross-device visitor flow analysis via a user ID. If you become a new customer and consent to tracking analysis, we can identify the channel or campaign through which you found us.

8. Social Media Plug-Ins
We do not use social media plug-ins on our website. Symbols of social media providers (e.g., Facebook) are used solely for passive linking to their respective pages.
We maintain publicly accessible profiles on various social networks. Visiting these profiles triggers multiple data processing operations. Below is an overview of the personal data we collect, use, and store when our profiles are visited.
Your personal data is collected, used, and stored not only by us but also by the operators of the respective social networks, even if you do not have a profile there. The scope and nature of these processes vary by operator and are not necessarily aligned with Tradias’ processing activities.

Contact via Social Media:
If you use our social media profiles to contact us (e.g., via posts, reactions, or private messages), we process the data you provide solely to communicate with you. The legal basis is Art. 6(1)(f) GDPR. If the contact aims to initiate a business relationship, Art. 6(1)(b) GDPR also applies.

9. Data Subject Rights
You have the right:
  • Under Art. 15 GDPR, to request information about your personal data processed by us, including processing purposes, data categories, recipients, storage duration, and rights to rectification, erasure, restriction, objection, or complaint;
  • Under Art. 16 GDPR, to request immediate correction or completion of your personal data;
  • Under Art. 17 GDPR, to request deletion of your personal data, unless processing is necessary for freedom of expression, legal obligations, public interest, or legal claims;
  • Under Art. 18 GDPR, to request restriction of processing if accuracy is disputed, processing is unlawful but you oppose deletion, or we no longer need the data but you do for legal claims;
  • Under Art. 20 GDPR, to receive your provided data in a structured, common, machine-readable format or request transfer to another controller;
  • Under Art. 7(3) GDPR, to revoke your consent at any time, halting future processing based on that consent;
  • Under Art. 77 GDPR, to lodge a complaint with a supervisory authority, typically at your place of residence, workplace, or with the authority responsible for Tradias GmbH in Wiesbaden.

10. Right to Object
If your personal data is processed based on legitimate interests under Art. 6(1)(f) GDPR, you may object under Art. 21 GDPR if reasons arise from your particular situation or if the objection is against direct marketing. 11. Data Security
We use the SSL (Secure Socket Layer) protocol during website visits, with the highest encryption level supported by your browser (typically 256-bit, or 128-bit v3 if unsupported). You can verify encrypted transmission via the closed key or lock symbol in your browser’s status bar. We also employ technical and organizational measures to protect your data against manipulation, loss, destruction, or unauthorized access, continuously improving these measures with technological advancements.

12. Up-to-Dateness and Amendment of This Privacy Notice
